1. Agreement to these Terms

These Terms of Service (the "Terms") are a binding agreement between you and Polystic ("Polystic", "we", "us") covering your use of the website, application, and services available at polystic.app (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. What Polystic is, and what it is not

Polystic is an AI-powered research and education tool for prediction markets. It analyzes markets on platforms such as Polymarket, Kalshi, and PredictIt and produces verdicts, suggested entry and exit levels, daily picks, coaching conversations, and a paper trading simulator.

Polystic does not provide financial, investment, tax, or legal advice, and it is not a broker, exchange, betting service, or gambling operator. The Service is read-only: we never hold your funds, never connect to your wallets or exchange accounts, and never place bets on your behalf. Everything the Service produces is information for you to evaluate. Every decision to stake money, and every outcome of that decision, is yours alone.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) and legally able to enter into these Terms. Prediction markets are restricted or unavailable in some jurisdictions. You are responsible for making sure that your use of those platforms, and of the Service, is lawful where you live. Polystic does not grant you access to any trading platform.

4. Your account

Provide accurate information when signing up and keep it current. Sign-in works through your email address or Google account, so keep those secure: anyone with access to them can access your Polystic account. You are responsible for activity under your account. One account per person. Tell us promptly at polystic@proton.me if you suspect unauthorized use.

5. Free tier

Free accounts include a limited number of AI analyses per day and a limited feature set. We may adjust what the free tier includes at any time. Circumventing limits, for example by creating multiple accounts, is not allowed and may lead to suspension.

6. Premium subscription and billing

Premium currently costs $1 for the first billing period and $39 per billing period afterwards. Each billing period lasts 30 days. The exact price is always shown at checkout. The subscription renews automatically at the end of each billing period until you cancel.

Billing is handled by Whop. Checkout takes place on whop.com and is additionally subject to Whop's buyer terms. We never see or store your payment details.

You can cancel anytime from Settings in the app or from your Whop account. Cancellation takes effect at the end of the current billing period, and you keep Premium access until then. Payments already made are not refunded for partial periods, except where the law requires otherwise or where we decide otherwise in an individual case.

We may change prices. A price change does not affect the price of your active subscription unless we notify you in advance and give you the opportunity to cancel before it applies. If a renewal payment fails and cannot be collected, your account moves to the free tier.

7. Acceptable use

• Use the Service only for lawful purposes and in line with these Terms.
• Do not scrape, bulk-export, resell, or redistribute the Service or its outputs as a product, service, or dataset.
• Do not reverse engineer, probe, overload, or disrupt the Service, and do not circumvent rate limits or access controls.
• Do not upload content you have no right to share, or content containing another person's personal data.
• Do not impersonate others or manipulate the leaderboard or paper trading simulator.

8. AI-generated content

The Service's outputs are generated by AI models and are probabilistic: they can be incomplete, outdated, or wrong, and market conditions change quickly. Confidence scores, edge estimates, and price targets are model estimates, not promises. Verify anything important independently before acting on it.

Past performance, including paper trading results, pick histories, and any statistics shown in the Service, does not predict or guarantee future results. Never stake money you cannot afford to lose.

9. Paper trading and leaderboard

Paper trading uses virtual balances that have no monetary value and cannot be deposited, withdrawn, or exchanged. Leaderboards rank paper trading performance. If we offer rewards or prize pools connected to leaderboards, they will be governed by separately posted rules and may be changed, paused, or discontinued at any time.

10. Intellectual property

The Service, including its software, design, and content we create, belongs to Polystic or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You keep the rights to content you upload and grant us a worldwide, non-exclusive license to host and process it as needed to operate the Service. If you send us feedback, we may use it without obligation to you.

Polymarket, Kalshi, and PredictIt are trademarks of their respective owners. Polystic is not affiliated with or endorsed by any of them.

11. Third-party services

The Service integrates third parties, including Google for sign-in, Whop for payments, and public market data platforms. Their services are governed by their own terms and policies, and we are not responsible for them.

12. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the maximum extent permitted by law, Polystic is not liable for trading or betting losses, lost profits, or any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for all claims connected to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights and liability for intent or gross negligence where applicable.

14. Indemnification

You will indemnify and hold Polystic harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Suspension and termination

You may stop using the Service at any time. Cancel your subscription in Settings, and email us at polystic@proton.me if you want your account and data deleted. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create legal or security risk. If we terminate your account without cause while you have paid for an ongoing billing period, we will refund the unused portion. Sections that by their nature should survive termination (including sections 10, 12, 13, and 14) survive.

16. Changes to the Service or these Terms

We may add, change, or discontinue features at any time. We may also update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms; if you do not agree, cancel your subscription and stop using the Service before that date.

17. Governing law

These Terms are governed by the laws of Hungary, without prejudice to any mandatory consumer protections of the country where you live. Disputes will be resolved by the competent courts of Hungary unless mandatory law provides otherwise. Before going to court, please contact us at polystic@proton.me: most issues can be resolved quickly and informally.

18. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and Polystic about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the Service.
